MUNICIPAL ORDINANCE NO. 04,  Series of 2008

AN ORDINANCE REGULATING VAN FOR HIRE OPERATING IN THE  MUNICIPALITY OF TRINIDAD, BOHOL BOUND FOR TAGBILARAN CITY AND/OR TO ANY POINT IN THE   PROVINCE OF BOHOL-

Be it ordained by the Sangguniang Bayan of Trinidad, Bohol in session duly assembled;

SECTION I. Operator(s) of VAN FOR HIRE who desires to operate in the Municipality of Trinidad shall fill up an Application for Permit to Operate Van for Hire at the Office of the Municipal  Mayor to be endorsed by the Chairman of the Committee on Public Utilities,  Fire and Public Safety of the Sangguniang  Bayan, Trinidad, Bohol who will  determine and evaluate applicants           qualification to operate, with the following   information and requirements:

SECTION II. Qualified Applicants who have been endorsed  by the Chairman of the Committee on Public Utilities,  Fire and Public Safety, Office of the Sangguniang Bayan to the Office of the Municipal Mayor  for final review of his/her application to operate  Van for Hire, and once approved  by said office, shall require payments of the following  at the Office of the Municipal Treasurer before issuance of a Mayor’s permit;   

SECTION III. Van For Hire Operator who have secured Mayor’s Permit shall be opened for public. No Operators shall be given priority.

SECTION IV. ROUTING SYSTEM.  In routing system, Van for Hire operation shall be in a daily rotation basis to start at:

SECTION V. The Local Chief Executive through her authorized representative with the  assistance of the Members of the Committee on Public Utilities, Fire and  Public Safety of the Sangguniang Bayan is responsible in the arrangement                       of the routing schedules and its rotation basis.

SECTION VI. Van for Hire Operators shall pay per trip ticket issued by the LGU-Trinidad before leaving station.

SECTION VII. In case the Van for Hire assigned in any prescribed hour to leave station  shall not proceed to its point of destination due to lack of passengers, driver shall be responsible to take and bring his passengers to the next Van For Hire either in Trinidad, Talibon or San Miguel leaving for   Tagbilaran City.

SECTION VIII. PARKING AREA. Van for Hire shall park at the designated parking area.  Junction of CPG Extension and National Highways at the side of the Municipal Plaza.

SECTION IX. VAN DISPATCHERS. Only the Local Chief Executive through the  recommendation of the Members of the Committee on Public Utilities, Fire and Public Safety shall determine whether or not dispatcher(s) is/are needed. In case dispatcher is allowed, the Committee on Public Utilities Fire and Public   Safety shall recommend the name to the office of the Municipal Mayor who shall require the qualified dispatcher to secure Mayor’s Permit subject to terms and conditions prescribed by the Sangguniang Bayan and approved by the Local Chief Executive.

SECTION X. ENFORCEMENT AND IMPLEMENTATION. The Municipal Mayor   with the assistance of the Members of the Committee on Public Utilities, Fire and Public Safety, Municipal Treasurer and the PNP through its  traffic officer shall enforce this Ordinance.

SECTION XI. PENAL CLAUSE. Any violation of this Ordinance shall be a ground for disqualification/ suspension and / or revocation of Van for Hire operator’s Municipal permit to operate Van for Hire in the Municipality of Trinidad. 

SECTION XII. REPEALING CLAUSE. Any other ordinances, rules and regulations found inconsistent with this ordinance shall be repealed or modified accordingly.

SECTION XIII. EFFECTIVITY. This Ordinance shall take effect immediately upon its  approval.
