AN ORDINANCE IMPLEMENTING THE RULES AND REGULATIONS OF THE EARLY RETIREMENT PROGRAM INCENTIVE SCHEME (ERPIS)
WHEREAS, In the midst of challenges by globalization, demographic pressures and scarce resources, the government has to define its proper role in society, focus its effort on its core governance functions and improve its performance;
WHEREAS, for it to attain improved performance, the municipality has to institute reforms that would make the bureaucracy into an efficient and result-oriented organization;
WHEREAS, guided by the rationalization program issued by the President, the Municipal Government has devised a scheme of providing incentives to its personnel who will opt to retire or be separated from service under the Early Retirement Program Incentive Scheme (ERPIS);
NOW THEREFORE, BE IT ENACTED by the Sangguniang Bayan of Trinidad, Bohol in session duly assembled:
SECTION 1. Title. This ordinance is known as the Early Retirement Program Incentive Scheme (ERPIS);
SECTION 2. Coverage. The ERPIS provides incentives to LGU-Trinidad personnel opting to retire or be separated from service in view of the above program;
SECTION 3. Availment Period. The ERPIS shall be offered only from MAY 01 to JUNE 30, 2008. Employees who will file their retirement application beyond this period will no longer be entitled to the incentives;
SECTION 4. Funding Allocation. The amount allocated for the implementation of this Ordinance shall be from the budget of this municipality;
SECTION 5. Benefits Granted. The incentives for employees who opt to retire are as follows:
• 64 years old - 1 month salary for every year of service up to the 12th year
• 60-63 years old - 1 month salary for every year of service up to the 15th year
• 59 years old and below - 1 month salary for every year of service
SECTION 6. Length of Service. The counting of the length of service starts from the effectivity of the permanent appointment of an employee. In case of the devolved personnel, the counting of the length of the service starts upon its devolution to the LGU;
SECTION 7. Payment Scheme. Employees who opt to avail of the program shall be paid in cash upon the approval of the employees retirement application by the Mayor;
SECTION 8. Payment Period. Payment will be made from January to February 2009;
SECTION 9. Separate and Distinct Benefits. The retirement benefits received under this program shall be over and above any such other retirement benefits ike the terminal leave benefits and others;
SECTION 10. Clearance of No Money and Property Accountability. Applicant must cleared from Money and Property Accountability upon claim of terminal leave benefits and all other claims from this municipality in line with the implementation of this ordinance;
SECTION 11. Applicants with Pending Administrative Case. The applicant of those with pending administrative cases punishable by dismissal or removal shall be held in abeyance until the final disposition of such cases without prejudice to their receiving benefits under this ordinance in case of acquittal;
SECTION 12. Restriction on the Employment and Replacement of Retired or Separated Personnel. Appointive officials and employees who are retired or separated under this program shall not be eligible for appointment in the municipal government whether permanent, temporary, casual or emergency status within a period of eight (8) years after retirement or separation;
SECTION 13. Separability Clause. If any part, section, or provision of this Ordinance shall be held invalid or unconstitutional, no other part or section thereof shall be affected thereby.
SECTION 14. Repealing Clause. All existing ordinances that are inconsistent with the provisions of this ordinance are hereby repealed or modified accordingly.
SECTION 15. Dissemination. Copies of this Ordinance shall be furnished to all Department heads of the municipal government, Commission on Audit (COA), Government Service Insurance System (GSIS) and Civil Service Commission Field Office.
SECTION 16. Effectivity. This Ordinance shall take effect upon its approval.
