AN ORDINANCE FIXING THE FEES IMPOSED ON PERMITS, CHARGES AND OTHER REGULATORY FEES AND CHARGES AND FOR OTHER PURPOSES.
Be it ordained by the Sangguniang Bayan of Trinidad, Bohol in session duly assembled;
SECTION I. Declaration of Policy: It has been the policy of the Local Government Unit of Trinidad, Bohol to exercise the powers expressly granted, those necessarily implied therefrom, as well as powers necessary and those which are essential to the promotion of the general welfare of its constituents.
SECTION II. Scope: Permits, Charges and other regulatory fees and charges of this Ordinance are hereby imposed on:
a.) Any person/s, entity or enterprise, for profit or not who are holding/conducting business in the Municipality of Trinidad, Bohol are required to secure Business Plate for each line of business;
b.) Franchise Holders, except those who are holding franchise from any Bureau/ Division of the National Government, and any Branch Offices of any entity, enterprise or corporations which are holding/conducting office or business in the Municipality of Trinidad, Bohol;
c.) All People’s Organization (POs), Cooperatives, Non-Government Organization (NGOs) subjects to the exemption granted by the concerned National Agency which are holding offices or conducting business in this municipality;
d.) Permittees operating within the Municipality of Trinidad, Bohol;
e.) All Operators of motor service for Hire that are being used or intended o be used in transporting passengers and goods for fee.
f.) Owner of the winning cock during cockfight held at Gallera de Trinidad, Trinidad, Bohol;
g.) Cultural Center
h.) Training Center
i.) Tourist Spots
SECTION III. Definition of Terms: As used in this Ordinance, the following definition of terms shall mean;
a.) Business - means trade or commercial activity regularly engaged in as a means of livelihood or with a view to profit.
b.) Cooperative - is a duly registered association of persons, with a common bond of interest, who have voluntarily joined together to achieve a lawful, common, social, or economic end, making equitable contributions to the capital required and accepting a fair share of the risks and benefits of the undertaking in accordance with universally cooperative principles. c.) Non- Government Organization (NGOs)-are local private organizations whose membership and activities are international in scope. d.) People’s Organization (POs) - are private organizations whose membership and activities are local in scope. e.) Fee- means a charge fixed by law or ordinance for the regulation or inspection of a business or activity f.) Charges - refer to pecuniary liability, as rents or fees against persons or property; g.) License/Permits - is a right or permission granted in accordance with law or by a competent authority to engage in some business or occupation or to engage in some transactions. h.) Franchise - a right or privilege, affected with public interest that is conferred upon private persons or corporations, under such terms and conditions as the government and its political subdivision may impose in the interest of public welfare, security and safety. i.) Operator- includes the owner, manager, administrator, or any other person who operates or is responsible for the operation of a business establishment or undertaking. j.) Person- means every natural or juridical being, susceptible of rights and obligations or of being the subject of legal relations k.) Business Plate- are prescribed plates featuring the corporate colours and imagery of the business, club or organization l.) Permittee- means one who to whom the permit to extract sand, gravel and other quarry resources is issued and is operating within the jurisdiction of the Municipality of Trinidad, Bohol. m.) Hauling Fee- is the charge made to the permittee for transporting sand, gravel and other quarry resources, agricultural products, such as cassava and palm oil. n.) Motor Service for Hire (habal-habal) – are those two-wheeled motorcycle that are being used or intended to be used in transporting passengers and goods for fee. o.) Supervision Fee- is a charge impose on the supervision on the operation of an organization or activities. p.) Cockfight or Sultada- is an actual fight of an evenly matched gamecocks where bets on either side are laid. SECTION IV. Rates. The following rates of fees, permits and charges to be imposed by the Municipal Government to wit: (a.) Business Plate - P 200.00 and renewable every (for: Section II.a) year at the rate of P 100.00 (b.) Mayor’s Permit - P 1,000.00/annum (for: Section II. b) (c.) Mayor’s Permit - P 500.00/annum (for: Section II. c) (d.) Hauling Fee - P 5.00/cu. meter for quarry and ( for: Section II.d) other quarry resources - P 50.00/truckload for agricultural products & commercial(peddlers) for 6- wheelers -P100.00/truckload for agricultural products &commercial(peddlers) for 10-wheelers and above (e.) Supervision Fee - P 250.00/annum (for Section II.e) (f.) Cockfight Fee (for Section II.f) - P 10.00/cockfight or sultada (Ordinary Cockfighting Day) - P 150.00/ cockfight or sultada (Derby) (g.) Cultural Center ( for Section II.g) For the venue - P 1,000.00 from 8:00 AM to 5:00 PM Beyond eight (8) hours additional charge of (P 125.00/ hour) Sound system -P 200.00/hour including consumption of electricity. Electricity - P 8.00/ Kwh (no sound system) (h.) Training Center (for Section II. h) Venue -P 750.00/ day
Kitchen -P 250.00/ day Tables -P15.00 each if rented and brought outside the Training Center Chairs -P3.50 each if rented and brought outside the Training Center Room accommodation -P 100.00 with beddings P 25.00 without beddings (i.) Tourist Spots (for Section II. i) a.) Batungay Cave Entrance fee - P 10.00/ head adult P 5.00/ head children Cottage - P 150.00/ day Spelunking facilities - P 10.00 each b.) Kawasan Falls Entrance fee - P 10.00/ head adult P 5.00/ head children Life raft - P 10.00 each Cottage good for 10 persons - P 50.00 Cottage good for 11 persons - P 100.00 & above SECTION IV. ENFORCEMENT AND IMPLEMENTATION. The Municipal Mayor through the Municipal Treasurer shall enforce this Ordinance. SECTION VI. PENAL CLAUSE. Any violation of this Ordinance shall be penalized with the following: First Violation - P 1,000.00 Second Violation - P 1,500.00 Third and succeeding - P 2,000.00 or revocation of business violation license/permit SECTION VII. REPEALING CLAUSE. Any other ordinances, rules and regulations found inconsistent with this ordinance shall be repealed or modified accordingly. SECTION VIII. EFFECTIVITY. This Ordinance shall take effect immediately upon its approval. “APPROVED” I HEREBY CERTIFY to the correctness of the foregoing Ordinance which was duly adopted by the Sangguniang Bayan during its regular session held on March 17, 2008.
